BY USING OUR WEBSITE AS A FAN YOU AGREE TO THESE TERMS – PLEASE READ THEM CAREFULLY

Introduction

These Terms of Use for Fans are additional terms which apply if you use Fans.Baby as a Fan (also referred to as "you" and "your" in these Terms of Use for Fans). These Terms of Use for Fans form part of your agreement with us.

Interpretation

• VAT: Refers to the United Kingdom's Value Added Tax and encompasses any additional or substitute taxes at the currently imposed rates. This includes comparable or analogous indirect taxes, charges, duties, imposts, or levies implemented by governmental entities at any level (state, federal, provincial, municipal) in other jurisdictions.
• Tax: Encompasses all forms of taxation and statutory obligations. This broad category includes charges, duties, imposts, contributions, levies, withholdings, or liabilities that are enforceable under the laws of any jurisdiction, including but not limited to the UK. This definition covers taxes imposed by any level of government, be it state, federal, provincial, local, or municipal.

General Terms

• Terms of Use for All Users: These are the basic terms governing your use of Fans.Baby.

• Privacy Policy: Explains how your personal data and other information collected about you is used.

• Acceptable Use Policy: Outlines permissible and prohibited activities on Fans.Baby.

• Complaints Policy: Details the procedure for lodging complaints about Fans.Baby and how they are addressed.

• Standard Contract between Fan and Creator: This contract, although not part of your direct agreement with us, dictates the terms for each Fan/Creator Transaction on Fans.Baby.

• Community Guidelines: Provides additional terms and guidelines for interactions within Fans.Baby.

Additional Applicable Terms

• For Creators: If you are also a Creator, the Terms of Use for Creators are applicable.
• For EU or UK Creators: Creators based in the European Union or United Kingdom must adhere to Platform to Business Regulation Terms.
• Fans.Baby Referral Program Participants: Terms of the Referral Program apply.

Your Commitments

• Age Requirement: You affirm being at least 18 years old or of legal contractual age in your residing country or State/province.
• Legal Compliance: You agree to comply with the laws of your residing country or State/province, including accessing Fans.Baby, viewing its content, and using its functionalities.
• Willingness to Pay: You are willing and able to make necessary payments for accessing content and functionalities on Fans.Baby.
• Information Provision: You agree to provide additional information or verification records as required by us.

Compliance and Ownership

• Compliance with Terms of Service: You guarantee that each piece of Content you post, display, upload, or publish on Fans.Baby fully adheres to the Terms of Service, particularly the Acceptable Use Policy.
• Ownership and Licensing: You confirm that you either own the Content and all associated intellectual property rights, or possess a valid license for its use.
• Third-Party Material: If your Content includes third-party material, you affirm having secured all necessary rights, licenses, consents, and releases for its use on Fans.Baby and subsequent exploitation.

Liability and Responsibility

• Accountability: If any of the warranties are found to be false, you agree to be accountable for any resulting loss or damage we suffer.
• Non-Endorsement: We neither endorse nor assume responsibility for any Content posted by you or other Fans.Baby users. We are not obligated to monitor the Content and have no direct control over its composition.

Subscriptions and Purchases by Fans on Fans.Baby

Fan/Creator Transactions

• Nature of Transactions: Fan/Creator Transactions are contractual agreements between Fans and Creators under the Standard Contract between Fan and Creator. We facilitate these transactions on Fans.Baby but are not parties to these contracts and bear no responsibility for the transactions.
• Creator Pricing Authority: Creators solely determine the prices for Fan/Creator Transactions within Fans.Baby’s pricing parameters. All prices are in USD.
• VAT and Fan Payments: Fan Payments are exclusive of VAT, which is added as applicable.

Payment Process

• Adding a Payment Card: To engage in a Fan/Creator Transaction, add a payment card to your account and click 'Subscribe' on the chosen Creator's profile.
• Payment Authorization: You authorize us to use your payment card details through a third-party provider for processing Fan Payments. All transactions are in USD. Currency conversion fees may apply, and we aren't responsible for such fees.
• Multiple Payment Cards: If the primary card is declined, another card provided will be used for the full Fan Payment.
• Subscription Payments: Periodic payments for Subscriptions and immediate payments for other Fan Payments (including tips) will be automatically debited.
• Subscription Renewal: All Subscriptions, except free trials, automatically renew unless the payment card is declined, the price increases, or you disable "Auto-Renew."
• Cancellation Policy: Cancelling a Subscription allows access to the Creator’s Content until the end of the current period. No further charges will be made for that Creator's Subscription post-cancellation.

Refund and Wallet Credits

• Refund Policy: Avoid unjustified refund requests for Transactions or tips. Bad faith claims may lead to account suspension or deletion.
• Wallet Credits: You can prepay "Wallet Credits" for future Fan Payments. Credits are non-refundable and don’t accrue interest. Full payment card charges apply if purchase exceeds Wallet Credits.

Account Suspension

• Effect on Payments: If your account is suspended, any due Fan Payments will also be suspended for the suspension period.
